The terms that apply when you buy downloadable original music directly from Public Malfunction.

1. About these terms

These terms apply to purchases of downloadable original music from Public Malfunction through publicmalfunction.org. Public Malfunction is the trader and rights holder for the recordings and compositions offered here. Contact contact@publicmalfunction.org with questions or complaints.

The Licence and Refunds & Downloads policy form part of these terms. Together, those three documents are the legal terms bundle identified by the version shown on each page and recorded with the order. Please read them before purchasing.

2. Products and ordering

Each product is downloadable digital content supplied without a physical item or subscription. The release page identifies the title, available formats and price. One purchase includes the formats shown at checkout for that release.

You are responsible for checking that the release and formats meet your needs and that the email supplied to Stripe is accurate and accessible. A contract is formed when payment is successfully accepted and Public Malfunction confirms the purchase.

3. Price and payment

Prices and currency are displayed before checkout. Stripe processes payment and calculates any applicable tax. The final amount is shown in Stripe Checkout before you pay. Public Malfunction does not store full card details or customer street, city or postcode information.

4. Immediate digital delivery

Before checkout, you must expressly consent to immediate supply of the digital content and acknowledge that the normal 14-day cancellation right will be lost once supply begins. We record the wording and version accepted and confirm it in the purchase email.

After Stripe confirms payment, secure access is made available through the purchase page and purchase email. Later access can be recovered through My Downloads. Temporary access and file-delivery links may expire for security, but this does not by itself end a valid paid licence.

5. Licence and customer responsibilities

Your purchase grants a limited licence for personal and commercial project use under the Public Malfunction Licence. Copyright is not transferred. Attribution is required, and standalone redistribution, resale, false ownership claims and Content ID or equivalent ownership claims are prohibited.

You must keep purchase-access links reasonably secure, use the files lawfully and make sure anyone working on your project follows the licence. Contact us before use if you are unsure whether a planned use is permitted.

6. Consumer rights and problems

Nothing in these terms excludes or limits rights that cannot lawfully be excluded. Digital content must be of satisfactory quality, fit for purpose and as described. If content is faulty, misdescribed or otherwise does not conform to the contract, you may be entitled to repair or replacement, a price reduction or a refund as applicable under consumer law.

See Refunds & Downloads for cancellation and problem-reporting information. Include the purchase email, release title and a clear description of the problem when contacting us; never send card details or passwords.

7. Availability and liability

We will take reasonable care to keep purchase recovery and downloads available, but internet and hosting services can experience interruptions. If we are responsible for a delivery fault, contact us so we can restore access or provide the remedy required by law.

We do not exclude liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or protected consumer rights.

8. Governing law and complaints

These terms are governed by the laws of England and Wales, without depriving a consumer of mandatory protections that apply where they live. Courts with jurisdiction under applicable consumer law may hear disputes.

We prefer to resolve problems directly. Email contact@publicmalfunction.org with the subject “Purchase complaint”. We will review the purchase record and respond as soon as reasonably possible.
