1. Personal use permission
Subject to payment and these terms, Public Malfunction grants the purchaser a non-exclusive, worldwide, non-transferable contractual licence for personal listening to the purchased music, storing the purchased files on the purchaser’s personal devices and making reasonable personal backup copies. One purchase includes every enabled MP3 and/or WAV format shown before checkout.
Public Malfunction retains its copyright and ownership. This purchase does not assign or transfer any copyright, ownership or authorship in the recording, composition, artwork or Public Malfunction brand. It does not guarantee that every individual generated element is independently copyrightable.
This version applies to purchases recording legal terms bundle version 2026-09-22. Earlier purchases retain the terms recorded with their order; this version does not replace or restrict those earlier grants.
2. Rights not included
The direct purchase is for personal use only. It does not itself authorise:
- use in monetised or commercial videos, or synchronisation to video;
- use in podcasts, games or apps, advertisements, films or TV, or client projects;
- use as production music in websites or presentations;
- broadcast or public-performance rights;
- resale, standalone redistribution, uploading or sharing of the purchased files;
- submission to stock or music libraries, or sublicensing;
- claims of ownership or authorship of the recording or composition;
- registration in YouTube Content ID, Meta Rights Manager or equivalent automated ownership, fingerprinting or claims systems.
You must not represent the personal download as permission for commercial, synchronisation or project use, or claim ownership of the music. Copyright notices and other ownership information must not be misrepresented.
3. Separate permissions and platform use
A separate use authorised by an authorised distributor, platform, rights-management or licensing service, or Public Malfunction is governed by that separate permission. Buying the personal download does not create or expand such permission. Nothing here restricts uses permitted by applicable law.
Buying the personal download does not automatically exempt later uploads from Content ID or equivalent rights-management claims. It is not evidence of commercial, synchronisation or project-use permission, and does not entitle the purchaser to manual allowlisting. We do not promise that an automated claim will or will not occur.
Broadcast, public-performance, communication-to-the-public, neighbouring-rights and collective-management rights or fees may apply separately. Any applicable permission or fees remain the responsibility of the relevant user, broadcaster, venue or platform.
4. Delivery, cancellation and statutory rights
The Terms and Refunds & Downloads policy govern immediate supply, cancellation and access recovery. The normal 14-day cancellation right is lost once supply begins only under the required conditions, including prior express consent and acknowledgement. Nothing in this licence excludes statutory rights concerning faulty, misdescribed or non-conforming digital content.
5. Breach and questions
The licence may be terminated if its material restrictions are breached and the breach is not remedied after notice where remedy is possible. Uses already lawfully made remain subject to applicable law.
